Bibob (Public Administration Integrity Assessment Act).

The municipality is increasingly faced with subversive crime. Undermining crime consists of all forms of crime that threaten the integrity of our society. Characteristic of undermining is the intertwining of the upper and underworld. Criminals use legal structures - such as permits, subsidies and government contracts - to carry out criminal activities. As a result, the integrity of the government is compromised. The Bibob Act provides the government with an instrument to protect itself against the risk of compromising integrity.

Bibob Act

The Bibob Act gives the government a tool to protect itself against the risk of compromising integrity. If there is a serious danger that, for example, a permit will be misused, the municipality can refuse the application or withdraw the permit issued. To determine the degree of danger, the municipality conducts its own investigation. The municipality may also request a recommendation from the National Bibob Bureau. This prevents the government from facilitating criminal activities and protects the competitive position of bona fide entrepreneurs.

For which permits apply?

The Bibob Act and its Decree apply to various municipal permits and exemptions, regulations and transactions, including:

  • Beverage and hospitality licenses.
  • Operating licenses for public establishments
  • Operating license for amusement arcades
  • Environmental permits for construction activities
  • Environmental activities environmental permits
  • Grants
  • Public procurement
  • Real estate transactions.

The municipality itself is responsible for the proper application of the Bibob Act. Therefore, policy rules have been established for each category. We will indicate in your permit application whether a Bibob test is required.

How do you arrange it?

What you need to know

A Bibob opinion is requested from the National Bibob Bureau in the following cases:

  • The prosecutor uses his tip-off function enshrined in the law and advises the municipality to request a Bibob opinion
  • Upon completion of the municipality's own investigation, there are still ambiguities about the application, such as:
    • the financing of the business
    • the company structure
    • circumstances surrounding the application, for example in the person of the applicant, the financier of the business or the owner of the premises in which the business is located.

What does it cost?

There is no charge for these applications.
