Personal data we process
The municipality of Gemert-Bakel processes personal data about you because you use our services and/or because you provide these data to us. You provide the data, for example, via a form on our website or by telephone. Below is an overview of the personal data we process:
- NAW data (Name, Address and City).
- BSN (Citizen Service Number).
- Gender
- Date of birth
- Birthplace
- Phone number
- Email address
There are also special personal data that are given extra protection by law because of a high possibility of invasion of someone's privacy. For applications and support in the areas of work, income, youth assistance, care and safety, the municipality may use special and sensitive personal data from you, such as financial, medical or criminal records.
Processing purposes as well as lawful basis
The municipality of Gemert-Bakel only processes (special) personal data when it has an explicit purpose and a legal basis for doing so. The legal bases are consent, agreement, legal obligation, vital interest, legitimate interest and public law duty.
Retention period
Personal data may not be kept by law longer than necessary for the purposes for which it was collected. The municipality of Gemert-Bakel will not retain personal data collected longer than is strictly necessary, or required by law, to realize the purposes for which the data was collected. In a number of cases, your data will be kept longer under the Archive Act.
Sharing with third parties
The municipality of Gemert-Bakel only provides your data to third parties if this is necessary for the execution of our agreement with you or to comply with a legal obligation.
We enter into a processing agreement with organizations that process your data on our behalf to ensure the same level of security and confidentiality of your data. The municipality of Gemert-Bakel remains responsible for this processing.

The municipality of Gemert - Bakel takes appropriate measures to prevent abuse, loss, unauthorized access, and other undesirable actions with personal data. Privacy statement Wpg municipality of Gemert-Bakel
The municipality of Gemert-Bakel employs special investigating officers (boa's) for supervision and enforcement of public order, environment and education. The boa processes personal and police data. This data may fall under the AVG or the Wpg.
- When a boa processes personal data in the performance of its supervisory duty, the AVG applies;
- If a boa processes police data for a police task - such as the prevention, detection or prosecution of criminal offenses - then the Wpg applies. The Wpg contains guidelines and rules for processing these police data. If applicable, the municipality uses your personal data for daily police tasks. Daily police tasks are described in Article 8 of the Wpg. Daily police duties include, for example, the enforcement of laws and regulations, such as the Code of Criminal Procedure, the General Local Government Ordinance and the Compulsory Education Act.
However, Articles 9 and 13 of the Wpg also list purposes for which we can process police data. These are so-called person-oriented investigations.
Examples of processing covered by the Wpg are:
- Writing an official report if you have committed a criminal offense, such as under the Compulsory Education Act (Article 8 Wpg);
- Declaring payments related to litigation (Article 8 Wpg);
- Investigation and detection of perpetrators of crimes (Article 9 Wpg);
- Detection of perpetrators of incidents to enable prosecution by the Public Prosecutor's Office (Article 9 Wpg).
Register of processing operations
We have a register of processing operations for the Wpg. The processing register lists all types of processing for the performance of our duties.
Police data security
Only employees authorized to do so are granted access to police data. They may only view the data they need to do their job. We may grant access to police employees. They too are given access only to the data necessary for their job.
Transfer of police data
To handle the payment of a fine, we pass your data to the Central Judicial Collection Agency (CJIB). We may pass on your data to investigative agencies, such as the police, in the context of detecting and preventing criminal offenses.
Retention periods
The Wpg regulates the retention periods for police data. Police data that the Boas process as part of their daily police duties - such as the detection of criminal offenses - the municipality retains up to 5 years after the date of the first processing. For investigations specifically aimed at persons or concrete events, so-called Article 9 processing, a retention period of 5 years after statute of limitations or an irrevocable judgment applies.
Your rights under the Wpg
As a data subject, you have the right to request access to your own police records from the municipality. The municipality does not provide any file(s). You will be given access to the police data known to us.You can submit a request for inspection via e-mail address: gemeente@gemert-bakel.nl. The municipality of Gemert-Bakel will process your request within 1 month.Pursuant to Article 28 of the Wpg, you can also request the municipality in writing to correct, supplement, delete or block your police data if your police data are factually incorrect, incomplete for the purpose of processing or irrelevant, or are being processed in violation of a statutory regulation.

Based on Article 27 from the Wpg, the municipality has the right to (partially) reject your request in the following cases:
- To avoid obstruction of judicial investigations or proceedings;
- To avoid adverse effects on the prevention, detection, investigation and prosecution of criminal offenses or the enforcement of penalties;
- To protect public safety;
- To protect the rights and freedoms of third parties;
- To protect national security;
- In the case of a manifestly unfounded or excessive request, as referred to in Article 24a, paragraph 4.
