Business description of the antecedent agreement including the plan compensation agreement redevelopment Kasteel Gemert
The Municipal Executive of Gemert-Bakel concluded an agreement with the developer in connection with the redevelopment of the castle area at Gemert on May 23, 2023. The agreement accompanies various zoning plans and environmental permits that enable the redevelopment of the castle area at Gemert. The exploitation area comprises the land, locally located in Gemert, cadastrally known GMT section H number 2389 and GMT section N number 591.
The operating agreement is a continuation of the concluded "Kasteel Gemert" development agreement as agreed with the developer on July 6, 2021.
The Spatial Planning Decree (Article 6.2.12) requires the municipality to publish a brief summary of these agreements within 2 weeks of the conclusion of the agreement. With this publication, we comply with it.
The purpose of the present agreement is to achieve the intended integral area development of the exploitation area locally known as "Kasteelgebied Gemert" and thus the realization of the project based on the assumptions included in the agreement.
The development area will be implemented in phases, consisting of the following phases.

The agreement describes the organization and consultation structure with the developer. Furthermore, the above phasing is linked to a schedule, describing when which plan documents must be delivered by the developer, so that the appropriate competent authority can begin to complete the necessary procedures in a timely manner.
Further agreements have been made about the execution of the project, such as the preparation of the project area for building and living, the realization of the necessary utilities and sewerage facilities, the layout of the public space of - and the surroundings of the castle complex. Hereby a damage settlement has been agreed upon with zero measurement, so that in case of any damage, a transparent recovery settlement has been agreed upon with the developer.
The agreement thereby regulates cost recovery and the operating contribution due within the framework of ground exploitation (Article 6.24 Spatial Planning Act).
A plan compensation agreement has also been signed with the developer for each phase.
There are also agreements on taxation, payment of amounts due, security, the term of the agreement and how any (interim) termination will take place, what ground rules apply to any transfer of the contract position, what ground rules apply if any amendment of the agreement must be made and how unforeseen circumstances will be dealt with. Finally, a dispute resolution procedure is included.
